1. Purpose and scope
These Terms of Sale (the "ToS") govern the sale of paid services offered on the photodidentite.com website (the "Site") by the company ILLUSION MEDIA LTD ("the Seller"). They apply to every order for a paid service and supplement the Terms of Use and the Privacy Policy of the Site.
Placing an order implies full and unconditional acceptance of these ToS. The customer declares having read them before confirming their order.
2. Access to paid services
Access to paid services is reserved for adults with full legal capacity. If the user is a minor, they declare having obtained prior authorisation from the holder(s) of parental authority. Access requires the user to hold a valid bank card (Carte Bleue, Visa or Mastercard).
3. Description of offers and prices
The price of the service is displayed inclusive of all taxes (VAT included) on the Site before any order. One offer is currently available:
24-hour trial at €0.50 VAT incl., giving access to unlimited compliance verification and unlimited photo formatting. After 24 hours, unless cancelled, the offer continues at €39.90 VAT incl. per 30-day period, automatically renewed.
A fair usage limit of 50 verifications and 50 formatting operations per day applies to all offers, to prevent abusive or automated use.
4. Automatic renewal and cancellation
Subscriptions are entered into without a fixed term and are automatically renewed every 30 days, unless cancelled by the customer. Cancellation can be made at any time from the customer account.
In accordance with Article L.215-1-1 of the Consumer Code, the customer may cancel their subscription online by a process at least as simple as the one used to subscribe. Cancellation ends the renewal: access remains active until the end of the current 30-day period, after which the subscription ends without further charge.
5. Payment terms
Payment is made by bank card, securely, via our payment service provider Stripe. Bank details are transmitted directly to this certified provider and are never stored on the Seller's servers. The first payment is due at the time of order; subsequent payments are automatically charged at each 30-day renewal, until cancellation.
6. Service provision
The service is provided online and accessible immediately after order confirmation and payment validation. Results (compliance report, preview, formatted file) are made available in the customer account and/or sent by email, generally within a few minutes.

The customer may submit a refund request to the Site's support team. Each request is reviewed by our team. If approved, the refund is made to the bank card used for payment, within a maximum of 5 business days.
9. Nature of the service and compliance
The service consists of verifying the compliance of a photograph with official standards and providing a corrected preview for informational purposes. As long as the photo does not meet the official criteria, the customer may rework it as many times as their offer allows.
The customer is expressly informed that a photograph generated or retouched by our artificial intelligence does not constitute an official identity photo and is not guaranteed to be accepted by administrations, embassies or official bodies, which generally require an unretouched photograph. The final acceptance decision rests with the recipient authority. The customer remains solely responsible for the compliance of their photo with the recipient body.
10. Liability
The Seller is bound by a best-efforts obligation. The Seller cannot be held liable in the event of an application being rejected by an administration, nor in the event of misuse of the service by the customer. The Seller cannot be held liable for indirect damages resulting from the use or inability to use the service.
11. Personal data
Data collected in connection with an order is processed in accordance with our Privacy Policy, in compliance with Regulation (EU) 2016/679 (GDPR). Invoices are retained for the legal period of 10 years provided for in Article L.123-22 of the Commercial Code.
12. Customer service and complaints
For any question or complaint, the customer may contact support at: david@illusionmedia.org. Any complaint must be submitted in writing before any recourse to mediation.
13. Consumer mediation
In accordance with Articles L.611-1 et seq. of the Consumer Code, after a prior written complaint that has not been resolved, the consumer customer may have free recourse to a consumer mediator.

In accordance with Regulation (EU) No 524/2013, the European Commission also makes available an Online Dispute Resolution platform. ec.europa.eu/consumers/odr.
14. Applicable law and disputes
These ToS are governed by French law. A consumer residing in France benefits from the protective provisions of their national law. Failing amicable resolution, the dispute may be brought before the competent courts.
