1. Purpose
These Terms of Use (the "ToU") define the terms and conditions for accessing and using the photodidentite.com website (the "Site"), published by the company ILLUSION MEDIA LTD ("the Publisher"). Any access to or use of the Site implies unreserved acceptance of these ToU.
2. Description of the service
The Site provides a tool to help verify and preview identity photos. It allows users to check whether a photograph meets official standards for a given document and country, and to view a corrected version for informational purposes.
Essential disclaimer. A photograph generated or retouched by our artificial intelligence is provided for informational purposes and strictly personal use. It does not constitute an official identity photo and is not guaranteed to be accepted by administrations, embassies or official bodies, which generally require an unretouched photograph. The user remains solely responsible for the compliance of their photo with the recipient body.
3. Site access
The Site is freely accessible for browsing and for the verification tool. Certain features are reserved for subscribers and governed by the Terms of Sale. The Publisher endeavours to ensure the availability of the Site but cannot be held liable for interruptions due to maintenance, technical failure or force majeure.
4. User account
Creating an account may be required to access certain features. The user undertakes to provide accurate information, maintain the confidentiality of their credentials and notify the Publisher of any unauthorised use of their account. Each user is responsible for actions carried out from their account.
5. Permitted use
The user undertakes to use the Site in accordance with the law and these ToU. In particular, they are prohibited from:
- uploading a photograph of a third party without their consent;
- using the service for fraudulent, unlawful or deceptive purposes;
- attempting to circumvent security measures or usage limits;
- automatically collecting, extracting or reusing Site content (scraping, bots);
- interfering with the operation of the Site or the rights of third parties.
6. Fair usage limits
To ensure service quality and prevent abusive use, a fair usage limit of 50 verifications and 50 formatting operations per day applies. These limits are shown in the customer account.
7. Photographs and user content
The user retains full ownership of the photographs they upload. By uploading them, they grant the Publisher a strictly limited and temporary licence to process them solely for the purpose of providing the service (analysis, formatting, preview). Photographs and associated data are processed in accordance with the Privacy Policy.
8. Intellectual property
All elements of the Site (texts, images, graphics, logo, icons, software, trademarks) are the exclusive property of ILLUSION MEDIA LTD or its partners. Any reproduction, representation, modification or distribution, even partial, without the express written consent of the Publisher, is prohibited.
9. Liability and warranties
The service is provided on a best-efforts basis. The Publisher does not guarantee that the result will be accepted by an administration and cannot be held liable for an application rejection. The Publisher cannot be held liable for indirect damages resulting from the use of the Site.
10. Links to third-party sites
The Site may contain links to third-party sites (directories, official resources). The Publisher has no control over these sites and accepts no liability for their content.
11. Personal data and cookies
The processing of personal data and the use of cookies are described in the Privacy Policy, in accordance with the GDPR and the CNIL's recommendations. Non-essential cookies are subject to the user's prior consent.
12. Amendments to the ToU
The Publisher reserves the right to amend these ToU at any time. The applicable version is the one in force at the time of access to the Site. Users are invited to consult them regularly.
13. Applicable law
These ToU are governed by French law. Any dispute relating to their interpretation or performance shall be referred to the competent courts, subject to the consumer protection provisions applicable to the consumer.
